Terms and conditions

This Terms and Conditions document ("Terms") is entered into by and between Mohawk Raceway Casino (the "Casino"), a gaming establishment located at Woodbine Mohawk Park, Campbellville, Ontario, Canada.

DEFINITIONS

For the purposes of these Terms:

1. "Casino" means Mohawk Raceway Casino and its affiliates.
2. "Games of Chance" means any game or contest of skill or luck played on the gaming floor of the Casino, including but not limited to slots, table games, and horse racing.
3. "You" refers to each individual who enters the Gaming Floor or participates in a Game of Chance.

AGE RESTRICTION

1. You must be at least 19 years old to enter the Gaming Floor or participate in any Games of Chance.

ID REQUIREMENT

2. You are required to provide valid government-issued identification (such as a driver's license, passport, etc.) before entering the Gaming Floor and participating in any Game of Chance.

SELF-EXCLUSION PROTOCOL

3. If you have self-excluded from gaming under Ontario's Self-Exclusion Program or are prohibited by law from engaging in gaming activities, You will not be permitted to enter the Gaming Floor or participate in Games of Chance.

DISCLAIMER OF LIABILITY

4. The Casino and its affiliates disclaim all liability for any loss, damage, injury, or other harm arising out of or related to participation in Games of Chance, including but not limited to any errors or inaccuracies on the gaming floor.

LIMITATION OF LIABILITY

5. In no event will the Casino's aggregate liability arising from these Terms exceed an amount equal to the total amount You have won during Your most recent visit to the Gaming Floor.

GOVERNING LAW AND JURISDICTION

6. These Terms shall be governed by and construed in accordance with the laws of the province of Ontario, Canada.

CHANGES TO TERMS

7. The Casino reserves the right to amend or modify these Terms at any time without prior notice.

BINDING EFFECT

8. You acknowledge that these Terms are binding on You as a condition of entry onto the Gaming Floor and participation in Games of Chance.

ENTIRE AGREEMENT

9. These Terms constitute the entire agreement between the parties regarding the subject matter contained herein and supersede all prior agreements, understandings, or negotiations, whether written or oral.

ACKNOWLEDGMENT

11. You acknowledge that the Casino has provided these Terms in accordance with provincial gaming regulations and is not responsible for any inaccuracies or inconsistencies contained within this document.

12. By accepting these Terms, you warrant that You are capable of entering into a legally binding agreement and understand its terms and conditions.

BINDING EFFECT TO ASSIGNS

13. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors, assigns, heirs, executors, administrators, and personal representatives.

GOVERNING LAW AND JURISDICTION (CONT'D)

14. Any disputes arising out of or related to these Terms will be resolved exclusively by a court of competent jurisdiction located in the province of Ontario, Canada.

15. These Terms shall not be subject to any conflicts-of-law rules and may only be enforced under the laws of the province of Ontario, Canada.

ENTIRE AGREEMENT (CONT'D)

16. No failure or delay on behalf of either party hereto in exercising any right granted herein will operate as a waiver of that right.

17. In case of conflict between these Terms and any other documents or agreements, these Terms shall prevail to the extent permitted by law.

BINDING EFFECT TO PARTIES

18. These Terms are binding upon You (including Your heirs, executors, administrators, successors, assigns) and on each of their respective agents, officers, directors, employees, contractors, partners, and affiliates.

ENTIRE AGREEMENT (CONT'D)

19. Upon acceptance by the parties, these Terms will represent the final agreement between them regarding all terms and conditions hereof.

TERMINATION

21. The Casino may terminate these Terms at any time by providing written notice to You of such termination.

22. Upon termination, all rights and obligations under these Terms will immediately cease to be effective except as specifically stated otherwise in this document.

24. Any disputes arising out of or related to these Terms will be resolved exclusively by a court of competent jurisdiction located in the province of Ontario, Canada.

ENTIRE AGREEMENT (CONT'D)

29. No waiver of any provision hereof by either party hereto will be effective unless specifically stated in writing, and then only to the extent so specified.

ACKNOWLEDGMENT

31. Upon signing this document, you acknowledge that You understand these Terms and are bound by their provisions as described herein.
